Detained Ecuadorians in the US: free consular help from Ecuador

Ecuador’s Ministry of Foreign Affairs and Human Mobility publishes two free consular services for these situations: assistance to Ecuadorians deprived of liberty abroad, and assistance to Ecuadorians detained abroad who are in deportation proceedings toward Ecuador, which includes guidance for their families. They are requested with a written request sent by email or delivered in person to the Ecuadorian Consulate or the corresponding Zonal Office, and there is no fee (gob.ec pages updated March 11, 2025, checked October 3, 2026). The limit the ministry puts in writing: “la decisión final sobre una deportación corresponde exclusivamente al país donde ocurrió la detención” (the final decision on a deportation belongs exclusively to the country where the detention occurred).

What the law quoted on the pages says

The page on people deprived of liberty quotes these articles of Ecuador’s Organic Law on Human Mobility:

  • Article 8 (consular protection): Ecuadorians abroad “recibirán la protección y asistencia oportuna de las misiones diplomáticas u oficinas consulares del Ecuador, cualquiera sea su situación migratoria” (will receive timely protection and assistance from Ecuador’s missions and consular offices, whatever their migration status). The same article says registering in the Single Registry of Ecuadorians Abroad “no constituye condición para acceder a los derechos previstos en esta Ley” (is not a condition for accessing the rights in this law).

What the consulate does not do

  • It does not decide the deportation. “Se precisa que la decisión final sobre una deportación corresponde exclusivamente al país donde ocurrió la detención, de acuerdo con su legislación interna.”
  • It does not intervene in court proceedings. Assistance to people deprived of liberty is given “dentro del marco de lo permitido por el Derecho Internacional y sin interferir en los procesos judiciales del país donde se encuentra el ciudadano privado de su libertad” (within what international law permits and without interfering in the judicial proceedings of the country where the person is held).
  • It is not legal representation in the US. The pages describe accompaniment, checking conditions and following the case. Article 12 legal assistance is for “casos excepcionales.” To look for free or low-cost legal representation in the US, see how to find pro bono legal help.

The two pages ask for similar information. Gather what you have:

How to request assistance

  1. Write a request addressed to the Ecuadorian Consulate or the corresponding Zonal Office. The pages say to send it to the consulate nearest your home (abroad) or the Zonal Office nearest your home (in Ecuador). To find the consulate, see the directory of Ecuadorian consulates or consulates by state.
  2. Send it by email or deliver it in person. You can also call for initial guidance.
  3. The case is registered. According to the page, consular staff or the Zonal Office will register the case, verify the information and provide accompaniment during the process.

Contact published on both pages: Directorate for the Protection of Ecuadorians Abroad (Dirección de Protección a Ecuatorianos en el Exterior), email dapee@cancilleria.gob.ec, phone 593 02 2993200 (extensions 14001, 17001, 18001, 15001, 13001 and 23001, per the page).

After a deportation: other Foreign Ministry procedures

  • Travel document: the gob.ec emergency-passport page lists the emergency passport for Ecuadorians when a national or foreign authority requires it in immigration proceedings ordering deportation or expulsion. That page says it is free and valid for 3 months.
  • Returning-migrant certificate: according to gob.ec, Ecuadorians declared vulnerable who return by force are issued the certificate even without two years abroad. See Ecuador returning-migrant certificate.
