- Confirme el estado actual en el registro EOIR — el reconocimiento puede ser retirado, y el registro se actualiza trimestralmente.
- Llame antes para verificar disponibilidad de servicios — muchas organizaciones tienen listas de espera, especialmente para casos de asilo y defensa contra deportación.
- Pregunte sobre tarifas antes de firmar un acuerdo de representación. Gratis o tarifa según ingresos es estándar.
- Lleve todos los avisos USCIS + identificación con foto a su cita inicial.
- Cuidado con los “notarios” — solo las organizaciones reconocidas por BIA O los abogados licenciados pueden dar asesoría legal. Un “notario público” en EE. UU. NO es notario en el sentido latinoamericano y no puede representarlo legalmente.

Contexto del programa de reconocimiento BIA (2025-2026)
El Programa de Reconocimiento y Acreditación de la Junta de Apelaciones de Inmigración (BIA) se rige por 8 CFR 1292.11-1292.16. El reconocimiento se otorga inicialmente por 3 años; las renovaciones requieren una nueva solicitud y documentación actualizada. Según el registro de EOIR del 2026-04-20: 1,256 organizaciones reconocidas operan 1,420 oficinas a nivel nacional, con más de 5,800 representantes acreditados entre Acreditación Total (representación en corte) y Acreditación Parcial (práctica solo ante USCIS).
Las organizaciones reconocidas por BIA no pueden cobrar honorarios a nivel de abogado, pero sí pueden cobrar “tarifas mínimas” — que EOIR típicamente define como aquellas que cubren únicamente los costos directos (impresión, franqueo, preparación de documentos). La mayoría de las organizaciones cobran entre $0 y $200 por representación completa en casos de rutina (trámites ante USCIS, audiencias de asilo defensivo). Compare con los honorarios de un abogado de inmigración privado: $1,500-$5,000 para casos de asilo, $2,500-$8,000 para cancelación de remoción, $1,500-$3,000 para ajuste de estatus.
EOIR pública el Registro de Reconocimiento y Acreditación trimestralmente en justice.gov/eoir/recognition-accreditation-roster-reports. Verifique el estado ACTUAL de una organización (Activa vs Renovación Pendiente vs Provisional vs Retirada) antes de firmar un acuerdo de representación. Las organizaciones cuyo reconocimiento fue retirado por EOIR (típicamente por fraude o problemas de cumplimiento) no pueden ejercer el derecho migratorio.
