Batavia Immigration Court

The Batavia Immigration Court was part of the Executive Office for Immigration Review (EOIR) within the U.S. Department of Justice. EOIR’s July 21, 2026 notice says the court, located within the Department of Homeland Security’s (DHS) Buffalo (Batavia) Service Processing Center, would close at the close of business on July 24, 2026 because DHS was unable to continue providing space for court operations. The notice says all pending cases would be transferred to the Buffalo Immigration Court and heard via video teleconference, and that EOIR would give official advance notice to all parties whose cases are reassigned. If you miss your hearing

Missing an immigration court hearing is serious. The judge can order you removed in absentia under INA § 240(b)(5)(A) — a deportation order issued without you present. Under 8 U.S.C. §1229a(b)(5)(C), such an order may be rescinded only on a motion to reopen filed within 180 days (exceptional circumstances) or at any time if you did not receive proper notice or were in Federal or State custody and the failure to appear was through no fault of your own. Form EOIR-33/IC says you must file it with the immigration court within five working days of a change to your contact information, and that the court sends all official correspondence (e.g., notices, decisions) to the address you provide.
