USCIS NOID (Notice of Intent to Deny) means USCIS plans to DENY your case unless you provide compelling response. ONLY 30-33 DAYS to respond. Get attorney IMMEDIATELY.

🔴 Update — August 5, 2026: a NOID is no longer guaranteed before a denial

USCIS Policy Alert PA-2026-05, issued Aug. 5, 2026, restores officers’ full discretion to deny a benefit request without first issuing a NOID or an RFE when the initial evidence the form instructions require is missing, or when the record does not establish eligibility. It is effective immediately and applies to requests pending or filed on or after Aug. 5, 2026. Under the previous policy, officers were encouraged to issue a NOID when a requestor submitted little or no evidence; that instruction is gone. The guidance sits in Policy Manual Volume 1, Part E, Chapter 6.

The 30-day maximum for a NOID response is unchanged — it comes from 8 CFR 103.2(b)(8)(iv), which also states that additional time may not be granted. A notice served by mail adds 3 days (8 CFR 103.8(b)), which is where 33 days comes from. USCIS has eliminated the extra 14 days it used to add for notices mailed outside the United States.

A NOID still remains the appropriate step when you filed all required initial evidence but that evidence does not establish eligibility (8 CFR 103.2(b)(8)(iii)). What changed is the incomplete-filing case: that can now go straight to denial. Asylum and refugee applications are governed by separate regulations and are not covered by this guidance.

What to do

  1. Get IMMIGRATION ATTORNEY immediately (within 1-3 days). 2. Read NOID — understand WHY USCIS plans to deny. 3. Gather strongest evidence to rebut. 4. Attorney response is critical. 5. If denied, you can: appeal (Form I-290B), reopen, refile — but expensive and time-consuming.

Recent USCIS notice code context (2025-2026)

USCIS issues approximately 6 million notices annually including I-797 series (action notices) and various correspondence. Common I-797 variants: I-797 (Approval), I-797A (Approval with replacement I-94), I-797B (Approval Notice / nonimmigrant), I-797C (Action Notice — receipts, transfers, biometrics scheduling), I-797D (companion to I-797C for sponsored I-130), I-797E (Request for Evidence / RFE), I-797F (Boarding Foil/Transportation Letter).

For RFEs (Request for Evidence — Form I-797E): respond by the deadline printed on the notice. Regulation caps an RFE response at 12 weeks (8 CFR 103.2(b)(8)(iv)) and, since USCIS Policy Alert PA-2026-05 of Aug. 5, 2026, officers no longer give the full 12 weeks as standard, so the deadline is often shorter. Extra time cannot be granted, and USCIS may now deny an incomplete filing without issuing an RFE at all. Submit response in ONE package with the original I-797E attached + all requested evidence with cover letter listing each item. Missing the deadline triggers denial with refusal of fee refund. Common RFEs: missing translation certifications, marriage bona-fide evidence, employment verification for H-1B, asylum corroborating evidence.

For Notice of Intent to Deny (NOID) and Notice of Intent to Revoke (NOIR): respond by deadline OR your case will be denied / approval revoked. NOIDs typically allow 30-33 days; NOIRs vary. For ASC (Application Support Center) biometric appointments: reschedule via myUSCIS or call 1-800-375-5283 Monday-Friday 8:00am-8:00pm ET. Rescheduling allowed once or twice without case impact; abuse leads to denial.
