Form G-28 authorizes a licensed attorney or BIA-accredited representative to act on your behalf before USCIS.

When you need it

  • Anytime you have an attorney or BIA-accredited rep in your case
  • USCIS will send communications to your attorney instead of (or in addition to) you
  • Attorney can appear at interviews with you
  • Without G-28 filed, USCIS only deals with YOU directly

You don’t need G-28 if

  • Doing your own case (self-represented)
  • Just have a “preparer” (someone filling forms but NOT attorney) — they use Form G-28I (paralegal/notario)
  • Your advisor is a “notary public” (NOT ATTORNEY) — this is not legal representation and is ILLEGAL if they give advice

Who can sign Form G-28 as representative

  1. Attorney licensed in any US State Bar
  2. BIA-Accredited Representative working for recognized nonprofit
  3. NOT valid: notary publics, paralegals, immigration consultants without credentials

What is Form G-28?

Do I need to file a G-28?
Only if you have a lawyer or an accredited representative. If you file your case yourself (pro se), you do not need a G-28 — it is not required to submit an application.
Does Form G-28 cost anything?
No. There is no USCIS fee for filing Form G-28. Your attorney files it together with your application or separately to enter their appearance.
Can a notario or non-attorney file a G-28?
