Form G-28 authorizes a licensed attorney or BIA-accredited representative to act on your behalf before USCIS.
When you need it
- Anytime you have an attorney or BIA-accredited rep in your case
- USCIS will send communications to your attorney instead of (or in addition to) you
- Attorney can appear at interviews with you
- Without G-28 filed, USCIS only deals with YOU directly
You don’t need G-28 if
- Doing your own case (self-represented)
- Just have a “preparer” (someone filling forms but NOT attorney) — they use Form G-28I (paralegal/notario)
- Your advisor is a “notary public” (NOT ATTORNEY) — this is not legal representation and is ILLEGAL if they give advice
