⚠️ OBBBA change effective 2026-05-29

The One Big Beautiful Bill Act (H.R.1, Public Law 119-21) creates a new $24 immigration fee on Form I-102 filings, layered on top of the existing Form I-102 filing fee.

When to use which option

1. Just need a copy of your current I-94?

Use the CBP I-94 lookup at i94.cbp.dhs.gov. Enter your name, date of birth, passport number, and country of citizenship. Print the resulting record. This is free and immediate.

This works for most travelers who entered the US by air or sea since 2013. Travelers who entered by land at certain ports may also retrieve their electronic I-94 this way after a system update.

2. CBP made an error on your I-94?

The first stop is the CBP Deferred Inspection office at the nearest international airport. Bring your passport, visa, ticket, and any supporting documents. Deferred Inspection can correct CBP-side errors in the entry record — wrong class of admission, wrong admit-until date, missing entry — without a USCIS filing.

Locator: cbp.gov/contact/ports. Walk-in or scheduled appointment depending on the office.

3. Your paper I-94 was lost, stolen, mutilated, or destroyed?

File Form I-102 with USCIS. As of 2026-05-29, the total cost is:

  • Standard Form I-102 filing fee (check current USCIS fee schedule)
  • + $24 immigration fee (new, not waivable, required by H.R.1)
  • Biometrics fee (if required by case type)

Mail to the USCIS Lockbox listed on the current Form I-102 instructions. The lockbox address has changed historically — always verify on the USCIS Form I-102 page on the day you mail.

4. Need a replacement Form I-94W (visa waiver)?

Form I-102 also handles I-94W replacements. The same $24 OBBBA immigration fee applies.

Why your I-94 matters

The I-94 — not the visa stamp in your passport — is the operational record of your current status. Employers running E-Verify or completing Form I-9 employment eligibility verification rely on the I-94. State DMVs verifying lawful presence for a driver’s license use the I-94. USCIS adjudicating later petitions verifies your prior status via the I-94 record. The Social Security Administration uses the I-94 to determine SSN eligibility.

If your I-94 shows a different class of admission or a different expiration date than you expect, resolve the discrepancy immediately — before you apply for a benefit that depends on your status.

Required documents for Form I-102

  • Form I-102 (signed)
  • Copy of any prior I-94 you still have
  • Copy of the biographical page of your passport
  • Copy of your most recent US visa (if applicable)
  • Photographs (per current USCIS I-102 instructions)
  • Police report (if I-94 was stolen)
  • Filing fee + the $24 OBBBA immigration fee

Common scenarios

  • My I-94 expired and I’m filing for extension/change of status: file Form I-539 (not I-102). The pending I-539 itself does not require an I-94 replacement.
  • My I-94 shows class B-2 but my visa is B-1/B-2: visit CBP Deferred Inspection first.
  • My I-94 admit-until date is wrong: CBP Deferred Inspection first; if they cannot fix it, then Form I-102.
  • I am a TPS, asylum, or adjustment applicant with no I-94: USCIS may issue an I-94 with an approval. Check your most recent USCIS notice. If you have an approval notice with an I-94 on the bottom, that is your I-94.

Frequently asked questions

What is the I-94 and why do I need it?
The I-94 Arrival/Departure Record is the official Customs and Border Protection (CBP) record of when you entered the US, in what status, and how long you’re authorized to stay. Employers, DMVs, SSA, and USCIS rely on the I-94 to verify your current immigration status. Since 2013, most I-94s are electronic and can be retrieved free at i94.cbp.dhs.gov.
What is the I-94 / I-102 fee after OBBBA?
Retrieving your electronic I-94 from CBP at i94.cbp.dhs.gov remains free. Filing Form I-102 with USCIS to request a replacement paper I-94 (Form I-94 / I-94W) now carries a $24 immigration fee effective 2026-05-29 per H.R.1 (One Big Beautiful Bill Act, Public Law 119-21). This $24 fee cannot be waived or reduced per statute. Federal Register document 2026-08333. The fee is in addition to the existing Form I-102 filing fee.
Do I need to file Form I-102 if my I-94 is electronic?
Usually no. Most travelers issued an electronic I-94 since 2013 can simply print a copy from i94.cbp.dhs.gov by entering their name, date of birth, passport, and country. File Form I-102 only if (a) you were issued a paper I-94 that has been lost, stolen, mutilated, or contains incorrect information; (b) you need a replacement for a Form I-94 / I-94W; or (c) you need a corrected version that the CBP Deferred Inspection office cannot provide.
What's the difference between I-94 status correction and I-102 replacement?
For corrections to a recent CBP entry record (wrong class of admission, wrong admit-until date, missing entry), the first stop is the CBP Deferred Inspection office at your nearest airport or port of entry. They can correct CBP errors without a USCIS filing. Use Form I-102 with USCIS only when the record needs to be replaced (lost/stolen) or when the underlying record cannot be corrected at the CBP level.
