Frequently asked questions

What is Form I-360 VAWA self-petition?
It lets certain abused spouses, children, and parents of US citizens or permanent residents petition for themselves — without the abuser’s knowledge or help — under the Violence Against Women Act (which protects victims of any gender).
Who can self-petition under VAWA?
An abused spouse or child of a US citizen or green-card holder, or an abused parent of a US-citizen adult. You must show the qualifying relationship, the abuse, and that you lived with the abuser.
Is the VAWA petition confidential from the abuser?
Yes. Federal law protects the confidentiality of VAWA self-petitioners — USCIS does not notify the abuser, and the abuser cannot access the case file. This protection is a core part of the program.
Is there a filing fee for the VAWA I-360?
The VAWA self-petition on Form I-360 has no filing fee. Confirm current details on the Form I-360 page at uscis.gov, and consider working with a VAWA-experienced legal nonprofit.
